Legal Update

On October 16, Atty James Meason appeared in court on behalf of plaintiffs in our lawsuit against NISC, Winnebago County, and the owners of the quarry located at 11200 N. Main St.

The discovery process is coming to an end, and we will soon be moving into the deposition phase. We will have the opportunity to depose their witnesses and they will be allowed to depose ours.

We have several expert witnesses who will testify regarding air and water pollution, decreased property values, and the effects an asphalt plant could have on our quality of life.

We know the case is moving slowly; it's what we've expected. What is most important to remember: as the 2019 construction season is coming to a close, THERE IS STILL NO ASPHALT PLANT. With our injunction in place, no construction can begin until this case is resolved. It is our hope that as time goes on, and markets change, the appetite for producing asphalt will diminish.

We have confidence in our case. Every day without asphalt production is a day with clean air and water. Our next court date is January 15, 2020.

The success of our lawsuit is driven by the financial support of this community. We set an initial goal of $30,000 and that is proving to be an accurate one.
