LEGAL UPDATE

Atty Meason appeared before Judge Fabiano on June 12 at 9am for the plaintiffs in our case against the permitted asphalt plant. The discovery process is continuing, and has admittedly, taken longer than anticipated. This is not bad news, as the injunction against the asphalt plant remains in place. Obviously, the longer discovery takes, the longer the process. Here's what we anticipate happening in the coming weeks/months:

1. NISC and Winnebago County (both defendants in this case), will complete their responses to our interrogatories.

2. We anticipate NISC will issue additional interrogatories for those plaintiffs who joined the suit after the initial filing.

3. An exchange of witness lists will take place: We will give them the information on who we anticipate testifying on our behalf, and they will do the same.

4. Once that is completed, additional interrogatories, (or possibly depositions) will be issued for those witnesses.

5. Once the discovery process is completed, we will move into the next phase of the process, which is likely a trial.

We all understand that this process has taken longer than anticipated. This is STILL A GOOD THING for us. Remember, there is a court order prohibiting any construction of an asphalt plant, and that remains until this entire process has been completed.

Even though this may seem like the movie Groundhog Day (at least we think so!), this is often what winning looks like. When you drive by the quarry, which many of us often do, look over - there is NO ASPHALT PRODUCTION because of YOUR support...because of what YOU have done to help us stand as a community against the plant.

Our next status hearing is August 14, 2019 at 9am. We are one step closer to a victory, and we have the guarantee of a summer without the threat of pollution of our water and air from the plant.
